“Hephaestus Ventures” and any related names, logos, product and service names, designs, and slogans are trademarks of Hephaestus Ventures LLC or our affiliates or licensors. You must not use such marks without our prior written permission.

4. Limitation of Liability

To the maximum extent permitted by applicable law, in no event will Hephaestus Ventures LLC, its affiliates, licensors, or service providers, or its and their respective officers, directors, employees, agents, or representatives, be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, including but not limited to loss of profits, loss of data, business interruption, or other intangible losses, arising out of or in connection with your use of or inability to use the Services, whether based on warranty, contract, tort (including negligence), or any other legal theory, even if we have been advised of the possibility of such damages.

To the maximum extent permitted by law, our total aggregate liability arising out of or relating to these Terms or the Services will not exceed the greater of (a) the amount you have paid to us for use of the Services in the twelve (12) months preceding the event giving rise to the claim, or (b) one hundred U.S. dollars (USD $100).

Some jurisdictions do not allow the exclusion or limitation of certain damages. In such jurisdictions, the above limitations may apply to you only to the extent permitted by the laws of such jurisdiction.

5. Governing Law and Dispute Resolution

These Terms and any dispute or claim arising out of or in connection with them or their subject matter or formation (including non-contractual disputes or claims) shall be governed by and construed in accordance with the laws of the State in which Hephaestus Ventures LLC is organized, without giving effect to any choice or conflict of law provision or rule.

You agree that any legal suit, action, or proceeding arising out of or related to these Terms or the Services shall be instituted exclusively in the federal or state courts located in that State, and you consent to the personal jurisdiction of such courts and waive any objection to such venue, including any objection based on forum non conveniens.

Any changes will be effective when posted unless otherwise specified. Your continued use of the Services after the posting of revised Terms means that you accept and agree to the changes.
